## 1. IMPORTANT INFORMATION
Welcome to **Finmaco**.
These Terms and Conditions (“Terms”) govern your registration for, access to and use of the Finmaco website, platform, applications, research tools, market data, artificial intelligence features, economic information, analytical services, subscriptions and associated services (collectively, the “Platform” or “Finmaco”).
Finmaco is developed, operated and/or provided in association with **Xavier McAllister**.
References in these Terms to “Finmaco”, “Xavier McAllister”, “we”, “us” and “our” include, where applicable, the owners, operators, developers, employees, contractors, analysts, economists, researchers and authorised service providers involved in operating the Platform.
References to “you” and “your” mean the person who creates or uses a Finmaco account or otherwise accesses the Platform.

- interest rates;
- central banks;
- inflation;
- employment;
- economic growth;
- economic indicators;
- market sentiment;
- institutional positioning;
- economic calendars;
- financial and economic news;
- market correlations;
- historical market information;
- quantitative research;
- technical analysis;
- market structure;
- fundamental and macroeconomic analysis;
- forecasts and consensus expectations;
- probability assessments;
- Finmaco-generated forecasts;
- artificial intelligence analysis;
- research reports;
- directional market biases;
- trade-planning tools;
- risk/reward calculations;
- market levels;
- historical studies; and
- other financial-market information and analytical functionality.
Features may be added, changed, improved, replaced or removed as Finmaco develops.

## 3. FINMACO IS A RESEARCH PLATFORM
Finmaco is designed to help users conduct financial-market research and make better-informed decisions.
The Platform combines information from various sources with analytical methods that may include economic analysis, quantitative research, technical analysis, statistical analysis, historical analysis, artificial intelligence, algorithms and rules-based systems.
Finmaco does not replace your own judgement.
Information presented through Finmaco should be considered part of your research process rather than an instruction to transact.

## 4. FINMACO DOES NOT PROVIDE PERSONALISED FINANCIAL ADVICE

They are not guarantees and must not automatically be interpreted as instructions to buy or sell.
A strong Finmaco bias can still prove incorrect.

## 6. TRADING INVOLVES SUBSTANTIAL RISK
Trading financial markets can result in substantial financial losses.
This is particularly important when using leveraged products such as Forex and CFDs.

- retention of funded accounts;
- prop-firm payouts;
- particular investment returns; or
- any other financial outcome.
Payment for Finmaco purchases **access to research, data, software and analytical functionality — not financial performance**.

## 8. PAST PERFORMANCE
Past performance is not a reliable indicator of future performance.
A strategy, market relationship, economic relationship, correlation or historical pattern that previously worked may subsequently perform differently or cease to work entirely.
Markets evolve.

## 9. FORECASTS AND PROBABILITY SCORES
Finmaco may produce:
- forecasts;
- directional probabilities;
- confidence assessments;
- bias scores;
- economic forecasts;
- market scenarios;
- quantitative probabilities;
- historical probabilities; and
- other forward-looking assessments.
These are estimates, not certainties.
A 70%, 80%, 90% or other probability displayed by Finmaco does not mean that the predicted event will occur.
Financial markets are affected by numerous variables and can behave differently from historical relationships or model expectations.

## 10. ARTIFICIAL INTELLIGENCE
Finmaco may use artificial intelligence and automated systems to analyse financial-market information.
AI-generated analysis can be incorrect.
Artificial intelligence systems may:
- misunderstand information;
- incorrectly classify information;
- produce inaccurate conclusions;
- make calculation errors;
- rely upon incomplete information;
- misinterpret market conditions;
- fail to identify relevant information; or
- generate conclusions that subsequently prove incorrect.
The use of artificial intelligence does not eliminate financial-market risk.
Users should independently verify material information before making significant financial decisions.

The Finmaco Intelligent Calendar may provide economic events, previous results, consensus forecasts, Finmaco forecasts, actual results, historical comparisons and related analysis.

Release times can change.
Actual economic results may differ materially from expectations.
Markets may also react differently from what would ordinarily be expected from a particular economic release.

## 14. INTELLIGENT NEWS
Finmaco may aggregate, analyse, classify, summarise or score financial and economic news.
Finmaco cannot guarantee that every market-moving event will be identified before markets react.
News may also be delayed, corrected, incomplete or subsequently contradicted.
Finmaco should therefore not be treated as your sole emergency or breaking-news service.

Finmaco may provide historical research, backtesting, statistical studies, quantitative analysis, historical replay and probability calculations.
Historical results may be affected by assumptions concerning:
- transaction costs;
- spreads;
- commissions;
- execution;
- liquidity;
- slippage;
- historical data quality;
- revised economic information;
- missing data;
- survivorship bias;
- selection bias;
- look-ahead bias; and
- model assumptions.
Historical research does not guarantee that the same relationship will continue.

# PART D — TRADING AND PROP FIRMS
## 16. TRADE-PLANNING TOOLS
Finmaco may provide tools capable of calculating or displaying:
- potential entries;
- stop-loss levels;
- profit targets;
- risk/reward ratios;
- technical levels;
- market structure;
- liquidity areas;
- support and resistance;
- position calculations; and
- other trading information.
These outputs are analytical tools.
They are not instructions to execute transactions.
The user makes the final decision.

## 17. PROP-FIRM USERS
Finmaco may be used by proprietary trading firm traders.
Finmaco is not responsible for determining whether a proposed transaction complies with a particular prop firm's rules.
Prop firms may impose rules concerning:
- daily drawdown;
- maximum loss;
- trailing drawdown;
- position size;
- news trading;
- overnight trading;
- weekend positions;
- consistency;
- prohibited strategies;
- maximum exposure; and
- payouts.
These rules can change.
You are responsible for checking the rules applying to your account.

## 18. PROP-FIRM LOSSES
Finmaco and Xavier McAllister are not responsible, to the extent permitted by applicable law, for a user's:
- failed prop-firm challenge;
- breached account;
- lost funded account;
- rejected payout;
- trading-rule violation; or
- termination by a prop firm
merely because the user relied upon Finmaco research or analysis.

## 19. BROKERS AND EXECUTION
Finmaco does not control your broker, prop firm, exchange or trading platform.
Your execution may be affected by:
- spreads;
- slippage;
- latency;
- liquidity;
- market gaps;
- rejected orders;
- requotes;
- broker pricing;
- platform failures;
- internet problems; and
- market conditions.
Finmaco does not guarantee execution at a displayed or calculated price.

# PART E — ACCOUNTS
## 20. ACCOUNT REGISTRATION
Certain Finmaco functionality requires an account.
You agree to provide accurate information when registering and to maintain appropriate security over your account.
You must not knowingly allow unauthorised persons to use your account.
You are responsible for maintaining the confidentiality of your credentials.

## 21. ACCOUNT SECURITY
You must notify Finmaco promptly if you reasonably believe your account has been compromised.
Finmaco may temporarily suspend access where reasonably necessary to investigate suspected fraud, misuse, security threats or unauthorised access.

## 22. ACCEPTABLE USE
You must not:
- attempt to gain unauthorised access to Finmaco systems;
- interfere with Platform security;
- introduce malware;
- scrape the Platform in breach of these Terms;
- reverse engineer protected components except where applicable law expressly permits it;
- systematically copy proprietary Finmaco research;
- redistribute paid Finmaco content without permission;
- resell account access;
- share paid credentials commercially;
- impersonate another person;
- use Finmaco to commit fraud or unlawful activity; or
- attempt to circumvent subscription or access controls.

# PART F — SUBSCRIPTIONS AND PAYMENTS
## 23. PAID SERVICES
Certain Finmaco functionality may require a paid subscription.
The applicable price, billing period and included functionality should be presented before payment.
Prices may change from time to time.
A price change will not ordinarily alter an already-paid subscription period.

## 24. RECURRING SUBSCRIPTIONS
Where you purchase a recurring subscription, Finmaco may automatically charge the applicable subscription fee at each renewal period until the subscription is cancelled.
The billing frequency and renewal terms should be disclosed during checkout.
You are responsible for cancelling before the applicable renewal if you do not want the subscription to continue.

## 25. IMMEDIATE DIGITAL ACCESS
Finmaco provides digital services.
Where permitted and applicable, by purchasing a subscription and expressly requesting immediate access, you request that supply of the digital service begins following successful payment.
Where applicable law requires specific consent or acknowledgement concerning commencement of digital supply during a statutory cancellation period, Finmaco may request that consent separately during checkout.
Nothing in these Terms removes a statutory right that cannot legally be excluded.

# PART G — REFUNDS AND CANCELLATION
## 26. REFUND POLICY
**Except where required by applicable law, payments made to Finmaco are final and non-refundable once payment has been successfully processed and access to the relevant paid digital service has been provided.**
This policy applies to, where applicable:
- monthly subscriptions;
- annual subscriptions;
- promotional subscriptions;
- discounted subscriptions;
- upgrades;
- premium research;
- Quant Research;
- AI features;
- analytical services;
- data services; and
- other paid Finmaco digital functionality.
Nothing in this section affects statutory rights that cannot lawfully be excluded.

## 27. CHANGE OF MIND
Except where a statutory right applies, deciding that you no longer want or need Finmaco after paid access has been provided does not create an automatic entitlement to a refund.
Likewise, failure to use the Platform does not automatically entitle you to reimbursement.

## 28. TRADING PERFORMANCE IS NOT A BASIS FOR REFUND
You are purchasing access to Finmaco — **not guaranteed trading results**.
A refund will not ordinarily be provided merely because:
- you lost money trading;
- a trade was unsuccessful;
- Finmaco's bias proved incorrect;
- a forecast proved incorrect;
- a probability did not materialise;
- you failed a prop challenge;
- you lost a funded account;
- your broker executed differently from expected;
- a market moved unexpectedly; or
- you did not achieve your desired return.
Financial-market uncertainty is an inherent part of trading.

## 29. CANCELLING A SUBSCRIPTION
You may cancel future subscription renewal using the cancellation method provided by Finmaco.
Unless otherwise required by applicable law, cancellation stops future renewal but does not retrospectively cancel an already-paid subscription period.
Access may continue until the end of the paid period unless otherwise specified.

## 30. DUPLICATE OR INCORRECT PAYMENTS
If you reasonably believe that you have been charged incorrectly or more than once for the same service, contact Finmaco support.
Legitimate billing errors will be investigated.
Nothing in these Terms prevents you from exercising payment or consumer rights available under applicable law.

## 31. CHARGEBACKS
Users retain legitimate rights to dispute unauthorised or incorrect transactions.
However, knowingly submitting a false or fraudulent chargeback or payment dispute may result in account suspension or termination and Finmaco may provide relevant transaction and acceptance records to the payment provider when contesting such a dispute.

## 32. PERSONAL DATA
Finmaco may process personal information necessary to operate and secure the Platform.
This may include, depending upon your use of the service:
- name;
- email address;
- account information;
- authentication information;
- subscription information;
- payment-related references;
- device information;
- browser information;
- IP/security information where appropriate;
- Platform activity;
- preferences;
- customer-support communications; and
- records of legal agreements you have accepted.

## 33. PRIVACY NOTICE
The **Finmaco Privacy Notice** explains in greater detail how personal information is processed.
It should identify, as applicable:
- the relevant data controller;
- contact information;
- categories of personal information;
- purposes of processing;
- lawful bases;
- recipients and processors;
- international transfers;
- retention periods;
- security measures;
- applicable user rights;
- complaints procedures; and
- relevant automated processing.
The Privacy Notice forms an important part of Finmaco's data-protection framework but does not replace these Terms.

## 34. SERVICE PROVIDERS
Finmaco may use third parties for functions including:
- hosting;
- cloud infrastructure;
- databases;
- authentication;
- payments;
- transactional email;
- cybersecurity;
- analytics;
- artificial intelligence;
- customer support; and
- financial-market data.
Personal information may be processed by these providers where necessary for the relevant service and subject to applicable data-protection requirements.

## 35. DATA SECURITY
Finmaco may employ reasonable technical and organisational security measures.
However, no internet-connected service can guarantee absolute security.
You are also responsible for securing your credentials and devices.

## 36. DATA RETENTION
Personal information should be retained only for as long as reasonably necessary for its relevant purpose, subject to legitimate legal, contractual, security, accounting and compliance requirements.

## 37. LEGAL ACCEPTANCE RECORDS
Finmaco may retain evidence that you accepted these Terms, the Financial Risk, Data & Platform Disclaimer and other applicable agreements.
This may include:
- your account identifier;
- document title;
- document version;
- document hash or equivalent integrity record;
- acceptance date and time;
- acceptance method;
- relevant security information where lawful and appropriate; and
- confirmation-email records.
These records may be maintained for legitimate contractual, compliance, security and evidential purposes.

# PART I — INTELLECTUAL PROPERTY
## 38. FINMACO CONTENT
Unless otherwise stated, Finmaco's proprietary software, branding, designs, analytical models, interfaces, original research, reports, databases, scoring methodologies, written material and other proprietary content are owned by or licensed to Finmaco, Xavier McAllister or the applicable rights holder.
Purchasing a subscription gives you access to the service.
It does **not** transfer ownership of Finmaco intellectual property.

## 39. PERSONAL LICENCE
Subject to these Terms, Finmaco grants you a limited, personal, non-exclusive, non-transferable right to access the Platform for permitted purposes during your authorised access period.
You may not commercially reproduce, redistribute or resell protected Finmaco content without written permission.

# PART J — PLATFORM AVAILABILITY
## 40. SERVICE INTERRUPTIONS
Finmaco aims to provide a reliable service but does not guarantee uninterrupted availability.
Interruptions may result from:
- maintenance;
- upgrades;

- hosting failures;
- database problems;
- cybersecurity incidents;
- third-party APIs;
- financial-data providers;
- internet infrastructure;
- external services; or
- events outside our reasonable control.
Temporary interruptions do not automatically create a right to reimbursement, although statutory rights and remedies remain unaffected.

## 41. CHANGES TO FINMACO
Finmaco is an evolving service.
We may add, modify, replace or discontinue features.
Where changes materially affect a paid service or users' contractual rights, they should be handled in accordance with these Terms and applicable law.

# PART K — RESPONSIBILITY AND LIABILITY
## 42. YOUR TRADING DECISIONS
You are responsible for your own trading and investment decisions.
You decide:
- whether to trade;
- what to trade;
- when to enter;
- when to exit;
- position size;
- leverage;
- stop-loss;
- profit target;
- broker;
- prop firm; and
- capital at risk.
**Finmaco provides research and analytical tools. You control the final decision and execution.**

## 43. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Finmaco, Xavier McAllister and their respective owners, operators, developers, employees, contractors, analysts, economists, researchers, affiliates and service providers shall not be liable for losses arising solely from a user's reliance upon financial-market information, research, forecasts or analysis provided through Finmaco.
Where legally permissible, this may include:
- trading losses;
- investment losses;
- lost profits;
- loss of trading opportunities;
- failed prop challenges;
- lost funded accounts;
- denied prop-firm payouts;
- indirect losses;
- consequential losses; and
- losses arising from third-party data or services.

## 44. LIABILITY THAT CANNOT BE EXCLUDED
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
Nothing in these Terms is intended to remove consumer, data-protection or other statutory rights that cannot legally be excluded or restricted.

# PART L — SUSPENSION AND TERMINATION
## 45. SUSPENSION
Finmaco may suspend an account where reasonably necessary because of:
- suspected fraud;
- non-payment;
- chargeback investigation;
- security threats;
- unlawful activity;
- material violation of these Terms;
- unauthorised redistribution;
- account compromise; or
- misuse of the Platform.

## 46. TERMINATION
Finmaco may terminate access for serious or repeated breaches of these Terms, subject to applicable contractual and legal requirements.
Termination resulting from serious misuse or breach does not automatically create an entitlement to a refund, except where required by law.

## 47. UPDATES
Finmaco may update these Terms to reflect:
- new functionality;
- changes in technology;
- changes in business operations;
- changes in third-party services;
- regulatory developments; or
- legal requirements.
Each version should contain an effective date and version identifier.

## 48. MATERIAL CHANGES AND RE-ACCEPTANCE
Where changes materially affect users' rights or obligations, Finmaco may require users to review and accept the updated Terms before continuing to access relevant Platform services.
Acceptance of a new version should be recorded separately from acceptance of previous versions.
Historical versions may be retained for evidential and compliance purposes.

# PART N — GENERAL TERMS
## 49. ENTIRE AGREEMENT
These Terms, together with the documents expressly incorporated or referred to within them, constitute the agreement governing your use of the relevant Finmaco services.

## 50. SEVERABILITY
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions should continue to apply to the extent permitted by law.

## 51. NO WAIVER
Failure by Finmaco to enforce a provision immediately does not necessarily constitute a waiver of that provision or any other rights.

## 52. TRANSFER
You may not transfer your Finmaco account or contractual rights to another person without permission where such restriction is lawful.
Finmaco may transfer its rights or obligations as part of a legitimate corporate restructuring, sale, transfer or reorganisation, subject to applicable law and without reducing mandatory consumer rights.

## 53. THIRD-PARTY SERVICES
Finmaco may contain integrations, information or links relating to third-party services.
Finmaco does not control independent third parties and is not responsible for their separate terms, privacy practices, products or services.

## 54. GOVERNING LAW AND JURISDICTION
These Terms shall be governed by the law specified by Finmaco in its final production legal configuration, subject to any mandatory consumer protections that apply based upon the user's jurisdiction.
**Before public launch, this section must be completed using the correct legal identity and jurisdiction of the Finmaco operating entity following legal review.**

Questions concerning:
- your account;
- subscriptions;

The final production version of these Terms should contain the legal name, registered address and required company/contact information for the entity operating Finmaco.

Before creating an account, the following acknowledgement should be presented:

Immediately before completing a paid subscription, Finmaco should display:

You are purchasing access to a digital financial-market research and analytical service. Finmaco does not guarantee trading profits, investment returns, successful prop-firm challenges or any other financial outcome.
**Except where required by applicable law, payments are non-refundable once payment has been processed and access to the paid Finmaco service has been provided.**
Cancelling a recurring subscription prevents future renewal but does not ordinarily result in a refund of an already-paid subscription period.
Where applicable, you may also be asked to expressly request immediate provision of the digital service and acknowledge the effect this may have on statutory cancellation rights.
